According to a host of experts, there are three key areas which the new Civic Platform (PO) and Polish Peasant Party (PSL) will have to work on as soon as they are sworn in. Furthermore, all three areas concern legislation which is not in line with European Union law. The first area concerns excise on electrical energy. Currently, Polish regulations are not aligned with EU law with the producers of electrical energy paying excise rather than suppliers. This matter has already been questioned by the European Court of Justice. The second key area relates to excise on imported cars collected by the tax authorities from the 1 May 2004 to the 30 November 2006. The European Court of Justice has also ruled on this matter with Polish excise on (EU) imported cars being illegal. The third key area is the liquidation of the 30% VAT sanction on goods and services. The Constitutional Tribunal (TK) has ruled on this maintaining that the VAT sanction infringes on regulations within the Polish Constitution. The new government is being urged to focus on these three key issues.
