Doctor Grzegorz Wrona of the Medical Chamber has decided that Professor Bogdan Chazan did not commit an offence when he refused to give an abortion to a patient and also did not recommend another doctor who might perform the surgery. With Dr Wrona’s decision, the disciplinary procedure against Chazan seemed to be officially dismissed. However, TVP Info has informed the public that Wrona’s decision is not legally valid. Parties to the proceedings may lodge an appeal to the Supreme Medical Court. Professor Chazan, commenting on Dr Wrona’s decision, told TVN24 that he is still claiming (in Labour Court) to be reinstated in his former position as hospital director. Professor Chazan said, “I hope this decision will give hope to nurses and doctors who are oppressed to follow their beliefs and continue applying the clause of conscience [a clause which allows doctors and nurses not to perform procedures against their religious views]. Perhaps, better times are coming for these people.” Professor Chazan refused to perform an abortion even though the foetus of the patient had very serious defects. In addition, he did not recommend any other doctor who might agree to perform the surgery or another medical facility where such surgery could be performed. The baby died shortly after being born.
